Agreement to Terms

Welcome to Bookeio. These Terms of Service ("Terms") govern your access to and use of our appointment booking platform, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

Definitions

  • "Service" - The Bookeio platform, including all features, tools, and services provided
  • "User," "You," "Your" - Any individual or entity using the Service
  • "Business User" - Users who create accounts to manage bookings for their business
  • "Customer" - End users who book appointments through the platform
  • "Content" - Any data, text, images, or other materials uploaded to the Service

Account Registration and Security

Registration Requirements

To use certain features of the Service, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Be at least 18 years of age or have parental consent
  • Not create an account using false or misleading information
  • Not create multiple accounts for fraudulent purposes

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Not sharing your account with others

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable local, state, national, or international law
  • Infringe upon the intellectual property rights of others
  • Transmit any malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service to send spam, unsolicited messages, or fraudulent content
  • Engage in any activity that disrupts or interferes with the Service
  • Scrape, harvest, or collect data from the Service without permission
  • Use automated systems or bots to access the Service
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, abuse, or harm other users

Payments and Billing

Subscription Fees

Certain features of the Service require payment of subscription fees. By subscribing, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Provide current, complete, and accurate billing information
  • Authorize us to charge your payment method for all fees incurred
  • Accept automatic renewal unless you cancel before the renewal date

Payment Processing

Payments are processed through third-party payment processors (such as Stripe, PayPal, or Viva Wallet). We do not store your complete payment card information. Your payment information is subject to the payment processor's terms and privacy policy.

Refunds and Cancellations

Subscription fees are generally non-refundable. You may cancel your subscription at any time, but you will not receive a refund for the current billing period. Service will continue until the end of the paid period.

For appointment bookings, refund policies are determined by the Business User providing the service.

Price Changes

We reserve the right to modify subscription fees at any time. We will provide advance notice of price changes, and changes will take effect at the start of your next billing cycle.

User Content and Data

Your Content

You retain ownership of all content you upload, post, or transmit through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and improving the Service.

Content Responsibility

You are solely responsible for your content and the consequences of posting it. You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your content
  • Your content does not violate any third-party rights
  • Your content complies with these Terms and applicable laws
  • Your content does not contain malicious code or harmful materials

Customer Data and GDPR Compliance

If you are a Business User collecting customer data through bookings, you must:

  • Have a lawful basis for processing customer personal data
  • Comply with applicable data protection laws (including GDPR, CCPA)
  • Provide appropriate privacy notices to your customers
  • Handle data subject requests (access, deletion, etc.)
  • Maintain appropriate security measures

Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Bookeio, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of our intellectual property without prior written consent.

Service Availability and Modifications

We strive to provide reliable service, but we do not guarantee that the Service will be:

  • Available at all times without interruption
  • Error-free or free from viruses or other harmful components
  • Compatible with all devices and browsers

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Impose limits on certain features or restrict access to parts of the Service
  • Perform scheduled maintenance with or without notice

Termination

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service will immediately cease.

Termination by Us

We may suspend or terminate your account and access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • You engage in fraudulent or illegal activities
  • We are required to do so by law
  • We decide to discontinue the Service

Effect of Termination

Upon termination, all rights granted to you will immediately cease. We may delete your data in accordance with our data retention policies. Provisions that should survive termination (including payment obligations, disclaimers, and limitations of liability) will remain in effect.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy or reliability of any information obtained through the Service
  • Warranties that defects will be corrected

We are not responsible for the conduct of Business Users or Customers, or for any content posted by users.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKEIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the greater of:

  • The amount you paid us in the twelve (12) months prior to the claim, or
  • One hundred dollars ($100)

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Bookeio, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use or misuse of the Service
  • Your violation of any rights of another party
  • Your content or data

Dispute Resolution

Informal Resolution

If you have a dispute with us, please contact us first at support@bookeio.com to attempt to resolve it informally.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bookeio operates, without regard to its conflict of law provisions.

Arbitration

Any dispute arising from these Terms or the Service that cannot be resolved informally may be subject to binding arbitration, except where prohibited by law. You waive any right to a jury trial or to participate in a class action.

General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Bookeio regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

No Agency: No agency, partnership, joint venture, or employment relationship is created between you and Bookeio as a result of these Terms or your use of the Service.
